1. Scope

These terms apply to all contracts for the use of the GOLF★STARS Distance Calculator (hereinafter “Calculator”) via https://weitenrechner.golf-stars.eu between Marcus Feuerbach, Dittersdorferstraße 4, 61137 Schöneck (hereinafter “we”) and our customers (hereinafter “you”).

2. Service

The Calculator is a web application that calculates shot distances, roll, clicks and percentage values for the computer game ShotOnline. The results are guide values; we give no guarantee of success in the game. We continue to develop the Calculator; updates are included in the price.

3. Account

To use it, you need an account with a valid e-mail address. You keep your login details and your license key secret. An account is only ever logged in on one device at a time; a new login ends the previous one.

4. Conclusion of contract and prices

The presentation of the plans does not constitute a binding offer. By clicking “Subscribe” or “Buy Lifetime” and completing payment on Stripe’s payment page, you submit a binding offer, which we accept by unlocking your access. The prices shown at the time of ordering apply: subscription €4.99 per month, Lifetime €49.99 one-time. In accordance with § 19 UStG, no VAT is charged.

5. Subscription

The subscription runs for one month at a time and renews automatically for another month unless you cancel it beforehand. You can cancel at any time in your account, effective at the end of the current month. Payment is due at the start of each month. After cancellation, access continues until the end of the paid period and then ends; amounts already paid are not refunded.

6. Lifetime

Lifetime entitles you to use the Calculator without time limit for as long as we offer the Calculator, including updates. A refund of the purchase price is excluded to the extent permitted by law.

7. Promo keys

Promo keys from promotions or giveaways can each be redeemed only once and are then bound to the redeeming account. They cannot be exchanged for money. We may deactivate keys that were obtained or passed on improperly.

8. Rights of use

You receive a simple, non transferable right to use the Calculator for your own purposes. You may not pass on your access or license key, copy, modify, reverse engineer or resell the Calculator or parts of it, or circumvent technical protection measures. In the event of violations we may block access; amounts already paid will not be refunded in that case.

9. Availability

We strive for uninterrupted operation. Short interruptions due to maintenance or updates are possible. Like ShotOnline, the calculator only works with an active internet connection; there is no offline mode.

10. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of slight negligence, we are only liable for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.

11. Right of withdrawal

Consumers have a right of withdrawal in accordance with the withdrawal policy. It expires early if you expressly agree that we begin the service before the withdrawal period expires and you confirm your knowledge of this.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. The language of the contract is German.
